Case of Baran Tursun                       
-  Crime Scene Izmir: Baran Tursun passed by polices waiting on the roadside when he was returning home with his car from a dinner program on 25th of November, 2007.  Polices flashed the headlights of their car to Baran who has passed and moved away from them.  Flashing headlights of their automobile from a distance of 250 meters was on the court records as “Baran was warned to stop”.  Media captioned as “What kind of warning is this?”

  -  With the claim of Baran Tursun not obeying warning to stop that was given by the polices from250 meters distance with their headlights , police shot Baran “by a straight and linear fire parallel to ground (Reasoned decision)”.  Polices screened firing and made it seem like a traffic accident, and prepared Traffic Accident Report.

Polices informed family of Baran and said “Your son made an accident, we took him to hospital, we did our best, unfortunately…“.  Father of Baran has also thanked to the murderer of his son, because of his statement “We did our best”.

  -  Baran whose heart failed (who is dead) is given to the hospital as “a citizen who made a traffic accident”; police and doctor issued reports in this direction.  Heart of Baran pumped incidentally when he was going to be taken to morgue. Tomography scans of the head of Baran whose heart worked were taken.  Firearm bullet was determined in the head of Baran in the BT.  It is revealed that in the case of Baran Tursun which was stated as traffic accident, Baran was in fact killed by police by firing to his head incidentally.

  -  Turkish courts found it appropriate to give 2 years of imprisonment to the police killing Baran, and closed the file.  However, family could not close the file.  Tursun family, who couldn’t secure justice in their country, carried the case onto international platform.

International platforms such as European Court of Human Rights, United Nations do not consider Baran Tursun case and violations of right to life in the same way Turkey and Turkish jurisdiction consider. 

  -  Christof Heyns, Reporter of United Nations, also does not accept Baran Tursun case as an isolated incident and does not think in the same as adjudicators in Turkey.  Reporter of  U.N. Christof Heyns says “Baran Tursun is murdered as a result of fire of police when he was moving in the traffic with his auto”, and gives wide coverage to this statement in his report.  Turkey report of Christof Heyns consisting of 21 pages was submitted to United Nations General Assembly in the 23rd session on 18.03.2013.

If we are to summarize case of Baran Tursun:

- One police have killed Baran Tursun

- Three polices obfuscated the evidences

- The polices perjured

- Two polices prepared report of traffic accident

- Four polices issued false documents

+ Despite these court records, three judges gave only 2 years of imprisonment....

Thus, we are saying “An adjudicator who can not establish justice, and who takes sides is more dangerous than the most vicious killer”.
